Welcome to Apaatos, operated by Katran Technologies Inc. ("Company," "we," "us," or "our"). By accessing or using the Apaatos platform (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

2. Eligibility

You must be at least 18 years of age and have the legal capacity to enter into binding contracts in Canada to use this Service. By using Apaatos, you represent and warrant that you meet these eligibility requirements.

3. Description of Service

Apaatos is an online platform that facilitates connections between landlords and prospective renters across major cities in Canada. We are solely a facilitator and intermediary. We do not:

• Act as a landlord, property manager, or real estate agent
• Own, manage, or control any rental properties listed on the platform
• Participate in, guarantee, or assume liability for any rental transactions or agreements
• Verify the accuracy, legality, or quality of listings
• Conduct background checks on users

4. User Accounts

To access certain features, you must create an account. You agree to:

• Maintain the security of your password and account
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

5. Landlord Responsibilities

If you post rental listings, you represent and warrant that:

• You have the legal right to rent the property
• All listing information is accurate, current, and not misleading
• Your listing complies with all applicable federal, provincial, and municipal laws, including fair housing and anti-discrimination laws
• The property meets all health, safety, and building code requirements
• You will respond to inquiries in a timely and professional manner

6. Renter Responsibilities

If you use the Service to search for rentals, you agree to:

• Provide honest information in all communications
• Conduct your own due diligence before entering any rental agreement
• Verify the legitimacy of listings independently
• Comply with all viewing and application procedures
• Respect landlords' property and time

7. Premium Listing Features

We may offer premium paid listing features for landlords, including enhanced visibility and additional promotional tools. Premium features:

• Are subject to separate pricing and payment terms
• Do not guarantee results or rental success
• May be modified or discontinued at any time with notice
• Are non-refundable unless otherwise stated

8. User Content and Listings

You are solely responsible for your content and warrant that it does not violate any laws or third-party rights.

9. Prohibited Activities

You may not use the Service to:

• Post false, misleading, or fraudulent listings
• Engage in discrimination based on race, color, religion, sex, national origin, disability, familial status, or other protected characteristics
• Harass, threaten, or abuse other users
• Post spam or unsolicited advertisements
• Violate any applicable laws or regulations
• Attempt to circumvent security features or access others' accounts
• Use automated systems to scrape or collect data
• Impersonate others or misrepresent your affiliation

10. Intellectual Property

The Apaatos platform, including its design, code, logos, and content (excluding user-generated content), is owned by Katran Technologies Inc. and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.

11. Disclaimers

• Users are who they claim to be
• Any rental transaction will be successful or satisfactory

12. Limitation of Liability

[LEGAL REVIEW REQUIRED] TO THE MAXIMUM EXTENT PERMITTED BY CANADIAN LAW, KATRAN TECHNOLOGIES INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING FROM:

• Your use or inability to use the Service
• Any rental transactions or agreements between users
• Fraudulent or misleading listings
• Property damage, personal injury, or financial loss
• Disputes between landlords and renters
• Any user content or conduct

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100 CAD, WHICHEVER IS GREATER.

13. Indemnification

You agree to indemnify, defend, and hold harmless Katran Technologies Inc., its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

• Your use of the Service
• Your content or listings
• Your violation of these Terms
• Your violation of any rights of third parties
• Any rental transactions or agreements you enter into

14. Governing Law and Jurisdiction
